人類史上最大規模的和平民主運動遭受殘忍鎮壓之後的廿年,中國政府仍拒絕給予其公民基本權力。劉曉波,一位中國重要的學者,同時也是零八憲章的發起人之一,仍被「軟禁」於北京西北方秘密地點的無窗戶單人牢房中,當局拒絕劉與律師聯繫,剝奪了憲法所賦予他的基本人權。4月16日,劉曉波的妻子劉霞,刊登一封給美國總統歐巴馬的公開信,這封信揭示了一部分中國政府當局因任意逮捕其公民導致受害人所必須付出的代價:
「雖然我和丈夫深知起草並簽署08憲章可能帶來的後果,但丈夫被拘留仍然給我們兩人帶來了巨大的痛苦。很早以前,我們倆人就商定不生孩子,不論是男孩女孩,父親被投入監獄對於他們來說總是件十分殘酷的事兒。所以,我們現在還是獨身。丈夫被拘押後,我們只能靠書信聯系,倆人不斷地給對方寫信,雖然我們知道這樣的信件也許對方永遠不會收到。在他被綁架的近4個月來,當局只允許我們見了兩次面。我被帶到一個秘密地點,我和丈夫一邊吃飯一邊談話,獄警一刻不停地在旁邊監視著我們。談話中我了解到,他一直被單獨關押在一個小房間裡,裡面只有一盞燈泡。我帶給他的60多本書,多數都被監獄官員沒收。想到他在監獄裡孤苦伶仃的生活,我趕到難以忍受。」
「現在我擔心,政府正在准備對他進行審判,試圖以“煽動顛覆國家政權罪”來判決他。當局經常用這個罪名來懲處持不同政見者,一旦按這個罪名判決刑期通常十分漫長。警方已經傳喚、調查了幾乎所有的原始簽署者,這是在搜集“證據”以便給我丈夫“定罪”。他們這樣做,也是在向所有的民主運動參與者發出明確的信號,告訴他們當局不會容忍持不同政見者。」

另一個相關的例子,遭囚關心愛滋病患者的維權人士胡佳之妻,曾金燕,在二月希拉蕊‧柯林頓訪問北京時,受監禁於自己的家中;這使得美國國務卿「人權不能與全球經濟危機相抵觸」以及「美國與中國最好在這議題上立場一致」的聲明更顯得可悲。與此形成鮮明對比的是,美國眾議院議長南希‧佩洛西 ─ 長期以來中國民主改革的擁護者,出面大聲疾呼支持零八憲章,並且再次呼籲「立即且無條件釋放」劉曉波:
